These Terms of Service ("Terms") govern your use of the website fonsekcompanies.com and all services provided by Fonsek Companies LLC, including its subsidiaries, brands, and projects such as Gold Manager, Inglés Fácil, and any other current or future entities under the Fonsek Companies umbrella.
By using our website or purchasing any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Services Overview
Fonsek Companies LLC provides the following types of services:
- Business Formation Services: LLC formation, EIN registration, BOI reporting, operating agreement preparation, and resale tax permit registration.
- Technology Services (Tech Studio): Custom web development, mobile applications, software solutions, and digital product management.
- Parent Company Operations: Management and administration of subsidiary brands and digital platforms.
2. Not a Law Firm
Fonsek Companies LLC is a document management and technology service provider, NOT a law firm. We do not provide legal advice, legal representation, or attorney-client relationships. The business formation and document filing services we provide involve preparing and submitting documents based on information you provide. For legal advice, please consult a licensed attorney in your jurisdiction.
3. Service Orders & Payment
- Pricing: All prices are listed in U.S. Dollars (USD) and are displayed on our website at the time of order. Prices may change without prior notice, but changes will not affect orders already placed.
- Payment: Payment is processed securely through Stripe, Inc. We accept major credit/debit cards. By providing payment information, you represent that you are authorized to use the payment method.
- Subscriptions: Some services may be offered on a recurring subscription basis (weekly, monthly, quarterly, or yearly). You authorize recurring charges at the agreed-upon frequency until you cancel.
- Order Confirmation: After submitting an order and completing payment, you will receive a confirmation email. This constitutes acceptance of your order by us.
4. Accuracy of Information
You are responsible for the accuracy and completeness of all information provided during the checkout process, including but not limited to:
- Legal names and dates of birth of all owners/members.
- Social Security Numbers (SSN) or Individual Taxpayer Identification Numbers (ITIN).
- Business names, addresses, and activity descriptions.
- Ownership percentages (which must total exactly 100% among all listed owners).
Fonsek Companies LLC is not responsible for errors, delays, or rejections caused by inaccurate or incomplete information provided by the client.
5. Refund & Cancellation Policy
- Before Processing: If your order has not yet been submitted to a government agency or work has not commenced, you may request a full refund by contacting us within 24 hours of purchase.
- After Processing: Once documents have been filed with a government agency or work has been completed, refunds are generally not available, as government filing fees and third-party costs are non-recoverable.
- Subscriptions: You may cancel a subscription at any time. The cancellation will take effect at the end of the current billing period. No partial refunds for the current period.
- Disputes: If you believe there is an error with your order, please contact us at info@fonsekcompanies.com and we will work to resolve the issue.
6. Processing Times
Processing times depend on the service and the relevant government agency:
- LLC Formation: Varies by state, typically 3–15 business days after submission.
- EIN Registration: Typically processed within 1–3 business days.
- BOI Reporting: Filed within 1–3 business days of receiving complete information.
- Other Services: Processing timelines will be communicated upon order acceptance.
Fonsek Companies LLC is not responsible for delays caused by government agencies, incomplete client information, or circumstances beyond our control.
7. Intellectual Property
All content on our website — including text, graphics, logos, icons, images, software, and design — is the property of Fonsek Companies LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
8. Technology Services
For custom technology projects (web development, mobile apps, etc.):
- Scope, timeline, budget, and deliverables will be agreed upon in a separate project agreement.
- Intellectual property rights for custom work will be defined in the project agreement.
- Fonsek Companies LLC retains the right to use anonymized project screenshots and descriptions for portfolio/marketing purposes unless otherwise agreed.
9. User Accounts
If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
10. Limitation of Liability
To the fullest extent permitted by law:
- Fonsek Companies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
- Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.
